Noble Facility Entry Agreement English

Welcome to RJ Noble Company.  By entering an R.J. Noble facility all employees, visitors, customers, and guests are required to follow the Loading and Offloading Safety Procedure. In following these procedures, you agree to abide by all rules and regulations. You must follow all posted safety rules, traffic signs, and verbal instruction from plant personnel while in our facilities.

All individuals must be equipped and use all required Personal Protective Equipment (PPE) during your visit. PPE must be used properly and must be in proper working condition to provide adequate protection from potential hazards.

When encountering heavy equipment, please remember they have the right of way. Make eye contact with the operator to be sure the operator sees you. Never assume the operator sees you. Once eye contact is made, wave and wait for a wave of acknowledgement from the operator before proceeding. The use of cell phones and all other electronic devices is prohibited while the vehicle is in motion or while loading is occurring.

Any violation of these procedures could result in restriction or refusal of entry to our facilities.

Offloading of Materials:

• Wear proper PPE

• Proceed to Dump Stand.

• The attendant will inspect your load and establish the type of material being offloaded

• Give attendant company name, drivers name and truck license plate

• Review and sign the acknowledgement form

• Attendant will instruct you where to go to dump

• Follow posted signs for material dumping

• Obey traffic control personnel when present

• Watch for heavy equipment as they have the right of way

• Never park behind any truck or heavy equipment

• Always wear your seatbelt while dumping

• Never exit truck with the box in the air

• If you are getting out of the truck, please ensure the box is down and it is safe to do so

• Uneven surface, watch out for trip and fall hazards

Loading of Materials:

• Wear proper PPE

• Proceed to Dump Stand

• Review and sign the acknowledgement form

• Drivers must observe all posted speed limits, yield to other traffic and follow designated routes to and from loading/unloading areas.

• Obtain lightweight on front scale, inform scale house of Company, PO, job location.

• Dispatch will inform you where to proceed to next (Yard or Hot Plant area)

• Yard: Check in with the loader for proper material loading

• Yard: Follow the posted road signs and exit by driving around the yard. Do Not Cross through the equipment area unless instructed to do so

• Hot Plant: Contact AC plant operator on intercom system.

• Hot Plant: AC plant operator will inform drivers when and on which scale, to enter for loading of asphalt.

• Loading: Drivers must remain attentive and in loading area during loading process. The driver shall remain in constant contact with R.J. Noble personnel during the loading process. • Loading: Prior to loading, trucks/trailers must be clean and free of material, the box should be sprayed with approved release agent if necessary. (spraying boxes with diesel is strictly prohibited).

• Hot Plant: Align under proper silo indicated with flashing light, and ensure windows are rolled up prior to loading. • Loading: Drivers must remain in vehicle at all times during loading process.

• Hot Plant: Truck will remain in place on scales, until receiving audible buzzer, and green light at the end of scale, indicating the loading process is complete.

• Proceed to the front scale for ticket receipt.

I have read and fully understand the Dumping Safety Procedure. I will abide by the standards set in the safety procedure and ensure that I will obtain and utilize all required PPE prior to dumping.

To the fullest extent permitted by law, including, but not limited to Civil Code Section 2782, I agree to defend, indemnify and hold the R.J. Noble Company (including its affiliates and related entities, collectively the Noble Parties) harmless from any and all Claims that may be brought against the Noble Parties by my or any of my employees, subcontractors, representatives or agents, or any legal representative or successor of any of them, in any way arising out of or incident to entry upon an R.J. Noble Company facility irrespective of whether such suits are brought about by the negligence or fault of the Noble Parties or anyone for whose acts the Noble Parties may be liable. I agree that my duty to defend shall begin immediately upon issuance of a tender of defense provided by the Noble Parties in accordance with Civil Code Section 2782.

Prior to entering an R.J. Noble facility, I agree to procure and maintain, at my cost and expense, the following insurance coverages naming Noble and the Noble Parties as "additional insureds" with respect to any liability arising out of Provider's ongoing and completed operations:

(a) Public liability and property damage insurance (“AL”) covering all owned, non-owned, and hired vehicles (issued by an insurer duly licensed and authorized to conduct business in the State of California which is rated at least A+ by the A.M. Best insurance rating agency in an amount not less than $1,000,000.00 (U.S. Dollars) per occurrence, or such larger amount as required by applicable law.

(b) Commercial General Liability (“CGL”) Insurance issued by an insurer duly licensed and authorized to conduct business in the State of California which is rated at least A+ by the A.M. Best insurance rating agency in an amount not less than $1,000,000.00 (U.S. Dollars) per occurrence and $2,000,000.00 in the aggregate, or such larger amount as required by applicable law Such insurance shall also cover Provider’s contractual liability under this Agreement. In the instances where Provider's services include the use of "pollutants" as defined by the Commercial General Liability policy, the policy must include an endorsement removing the absolute pollution exclusion and adding broadened pollution coverage for bodily injury and property damage resulting from the discharge, dispersal, seepage, migration, release or escape of "pollutants" as defined by the Commercial General Liability policy, and providing coverage on behalf of the "additional insured", including ongoing and completed operations.
